OAU Saga: The Virtual Rescue

The crow of a cock woke me to reality from a dream of resumption. I stretched and dragged myself out of bed with a short prayer; I actually murmured the few words. I had my small old radio all by my side wobbling as I dozed off the night after a broadcast with high hope of getting pleasant news to elate me from boredom of engulfed home alone.

An industrial revolt had struck my college and we were sent home for what they termed safety rather than cowardice. The days of waiting reminded me of the biblical Israelis sojourn in the desert; lost, tired and weary. Alas, the wait was more than that of the Isreali as it lasted more than a fold; about three chicken hatched chicks. It was getting much more devastating as I worried daily until one faithful night Virtual Games came to the rescue.
Least I forgot I am not a snob but was more dedicated to exploration which Edison Software Development Centre had in stock; I forgo the green bottles and the glass mugs overflowing with foams.

The Virtual space was a consolation from my school troubles. Explosion in the number of creative new games that my mobile facilitated was a key to my immense learning exposure.  My quest knew no bounds making me pedagogic and the experience was enthralling with the advanced location sensing capabilities such as the GPS Satellite Positioning in my mobile which transcended place and time.

The engaging and motivation from the game made learning a fun like adventure. Adventure because it was a combination of action, historical and role playing experience. The virtual visit to the museum was fascinating and near-reality as I saw lots of ancient artifacts. Yes, the opportunity to pick a role and explore the different possibilities the world affords for my career was quite exciting. (Chuckles) I avoided the role of a surgeon because of the fear that buckled in me holding a surgical knife like Ben Carson.

My experience was fun; my days of waiting for Mr. President’s intervention sprouted with my newly discovered companion in the virtual Space. The nearest future will be hugely electrifying when location-based games will contribute to Knowledge in my Country. Welcome to the Senate Tower Prof. Elujoba

Gay escapes Lynching in Challenge Area of Ibadan.

A man named Folorunsho Adebiyi recently escaped lynching at Challenge area in Ibadan the capital of Oyo State for same sex coordinated activities. According to residents in the area from findings gathered, Adebiyi is a reverend as a respected man of God caught in a secret meeting with the same sex (Gay) couples finalizing arrangement on their solemnization to be performed in a Church where he is an associated Pastor. The Church (name withheld) according to report has become an abode for established gays and initiates.

His nefarious activities was as well revealed in another publication (name withheld) of which the paper elaborates the activities of these people that lived underground existence life.

Adebiyi who has been declared wanted by the Nigerian Police force is currently on the run. it was gathered that he is hiding from being arrested by the authorities for his prominent roles in the homosexual circle.
It was reliably gathered that these people in the activities of homosexuality are well connected, in highly placed Government establishments as well society men and women who are into big time business are in the practice. Top musicians, Bank executives, high ranking Military officers and also politicians fall prey to such advances.

A Nigerian  reacting to the homosexual act in Ibadan under anonymity, stated that " the 14 years imprisonment for the gays and 10 years for their aids and coordinators is not enough because it has not prevented the crime so it should be reviewed" he added.

OAU Crisis: Buhari Directs Appointment Of Acting V.C

President Muhammadu Buhari has directed the Senate of the Obafemi Awolowo University, Ile Ife, Osun State to immediately recommend a qualified person for appointment, as an acting Vice Chancellor for the university.
 
In a letter addressed to the Executive Secretary of the National Universities Commission, the President directed the Senate not to consider any of the candidates who earlier contested for the position.

The letter further says the Senate of the university should take immediate steps to implement the directive of the President and report back to the Federal Ministry of Education.
Workers and students of the institution recently trooped out in jubilation following the dissolution of the school’s governing council and the suspension of the selection of the vice chancellor by the federal government.

According to the staff and students, the federal government’s decision was a step towards the redemption and integrity of the institution, which for weeks had been hit by crisis after the exit of the immediate past Vice Chancellor, Prof Bamitale Omole.

OAU Law Student Questions S. 271 AND 273 of the Criminal Code's Justification of HOMICIDE

Homicide is the killing of a human being. This could however be lawful or unlawful. It is the unlawful specie that the Criminal Code Act (Cap C38, LFN 2004)makes an offence in S. 306 generally while the lawful one is also given the force of law in some specified sections, e.g. S. 254 of the Criminal Code Acton the execution of court sentence. In the same vein, the 1999 constitution of the Federal Republic of Nigeria (as amended 2011) frowns at the violation of an individual’s fundamental right to life save in some exceptional circumstances which may justify such a violation.

(See S. 33 of the 1999 Constitution, as amended 2011) I am concerned in this article most especially with S. 33(2)(b) of the 1999 Constitution as it is from this section that S. 271 & 273 of the Criminal Code Act (which constitute the crux of this article) derive their existence and validity, the constitution being the grundnorm of Nigerian law. For purpose of convenience, the provisions of the aforementioned section of the Constitution are reproduced verbatim: S. 33 – (2) A person shall not be regarded as having been deprived of his life in contravention of this section, if he dies as a result of the use, to such extent and in such circumstances as are permitted by law, of such force as is reasonably necessary: (b) in order to effect a lawful arrest or to prevent the escape of a person lawfully detained A detailed explanation paragraph (b) above is contained in Sections 271 and 273 of the Criminal Code Act.

The provisions of both sections are supplied below. S. 271 provides thus: When a peace officer or police officer is proceeding lawfully to arrest, with or without warrant, a person for an offence which is a felony, and is such that the offender may be arrested without warrant, and the person sought to be arrested takes to flight in order to avoid arrest, it is lawful for the peace officer or police officer and for any person lawfully assisting him, to use such force as may be reasonably necessary to prevent the escape of the person sought to be arrested, and if the offence is such that the offender may be punished with death or imprisonment for seven years or more, may kill him if he cannot by any means otherwise be arrested. S. 273 provides: When any person has lawfully arrested another person for an offence, it is lawful for him to use such force as he believes, on reasonable grounds to be necessary to prevent the escape or rescue of the person arrested.

But, if the offence is not one which is such that the offender may be arrested without warrant, this section shall not authorize the use of force which is intended or likely to cause death or grievous harm. There is no doubt that the provisions of both sections above make homicide justifiable. I can interpret S. 271 to mean that if I am a policeman, and someone commits a crime which is a felony (not just any felony, but one which is either punishable with death or imprisonment for 7 or more years) and considering the nature of the offence he is committing or has committed, I can arrest him without warrant.

However, this ‘gentleman’ seeing me tries to run away in order to escape my lawful arrest, S. 271 empowers me to use a reasonable amount of force not to let him escape and I ‘may’ even ‘kill’ him in such a circumstance. S. 273 also justifies a killing subject to the circumstance that such an offender may be arrested without warrant. A paradigm of the offence envisaged above can be found in S. 159 of the Criminal Code as regards the unlawful importation of counterfeit coin.

The section provides: “Any person who without lawful authority or excuse, the proof of which is on him imports or receives into Nigeria any counterfeit coin whatever, knowing it to be counterfeit is guilty of a felony, and is liable to imprisonment for fourteen years. A person found committing the offence may be arrested without warrant.”

The issue I have with these two sections is that to what extent do they justify acts which ordinarily would have amounted to murder? From the illustration above, let’s say I decided to kill him (don’t forget the section uses the word “May”) because I’m fully satisfied that other elements (e.g. the offence is a felony, it is punishable with death or imprisonment for more than 7 years, the offender can be arrested without warrant, the offender tries to run away to avoid being arrested) that justify such a killing are in place, does my act not amount to punishing him for that crime despite that he has not been convicted by a court of law, bearing in mind also that S. 36(5) of the 1999 Constitution provides a presumption of innocence until actual guilt is proved? Or does finding a person committing an offence automatically prove his guilt or the fact that he runs away after such a commission? Or put differently, do S. 271 and 273 harbour the presumption that a person caught committing an offence and the run away in order to prevent being arrested is guilty of such an offence? Furthermore, considering the provisions of S. 36(5) of the 1999 Constitution, what presumption should be imputed on a person caught committing an offence but has not been charged?

Again, as a policeman, before pulling the trigger, can’t I imagine there is a possibility that he could be acquitted by the court of law if any of the defences which may be available to him is successfully proved?

Or can we safely conclude that S. 33(2)(b) of the 1999 Constitution is in conflict with S. 36(5) of the same Constitution? If it does, how do we resolve such a conflict? It is 17 years today (July 10, 1999- July 10, 2016) that violent neo-fascist elements (Black Axe confraternity) invaded OAU campus and murdered 5 revolutionaries comrades who are now regarded as OAU 5 matyrs. 

By their deeds and actions, i put it to you that George Akinyemi Iwilade, fondly called Afrika, 400-Level Law student, who was then the Secretary General of the Students’ Union, Eviano Ekeimu, 400-Level Medicine, Yemi Ajiteru, an extra year student, Babatunde Oke, 100-Level Philosophy, and Godfrey Ekpede are indeed Nigerian Marxists who should be acknowledged as models by contemporary Nigerian students for their proactive Jihadist against mass oppression, social vices and national injustice for an EGALITARIAN redress and reform. 

That these named heroes adopt mild methodologies to achieve wild technologies confirms them as peaceful revolutionaries... They sent the cultists to permanent oblivion on OAU campus without CCTV cameras, guns, musketeers etc, they will forever live as their legacies will jealously be guided by the succeeding generations of Great Ife students.

AUTOMATION AS A PRODUCT OF TECHNOLOGICAL ADVANCEMENT


The growth of technology cannot be deterred in this dispensation where world classed advancement is the major focus of countries around the globe. Because of technology, so many individuals, companies and nations around the globe have resorted to seeking easier and faster means of going about their lives. A long time ago, there was the use of the abacus as a counting process but with time this went extinct with the advent of computers and today with numerous other means; we can precisely talk about technology and the idea of automation.



Many of us don’t really come to terms with the term automation but we would most likely come to terms with the words: boilers, heat treating ovens, telephone networks, steering and a host of other means but the basic truth is that all of these are all automation processes.

 
Automation involves the use of various controlling systems for the purpose of operating so many processes in many locations.
